Whilst being a LiveTribe member is fun and rewarding there are also some terms and conditions that you need to be aware of. These are shown below.

TERMS AND CONDITIONS

1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions. The Promotion commences on 4/08/11 and ends on 12/12/11. The total value of the Prize Pool is a maximum of AU$3,000.


2. Entry is open to members of the LiveTribe Database (“Eligible Entrants”). Eligible Entrants must be registered with the Live Tribe Database at www.LiveTribe.com and have provided their email address and fully completed the registration page (including their personal information and demographic details, as prompted).Employees and their immediate families of the Promoter and its agencies associated with this Promotion are ineligible. Where a member is under the age of 18 years on the day of the draw (12/12/11), then the prize will be awarded to a parent or guardian on that minor’s behalf.


3. How To Enter
   
   

   3.1 Eligible entrants will receive between 1 and 100 entries into the Promotion when they:

   
   

   1. Maintain an active membership by participating in a survey activity at least once within the past 12 months or by registering as a new member of the Live Tribe Database within the past 12 months. One (1) entry is given to the promotion for each new or active member of the Live Tribe Database at the time of the draw.
   
   
   2. Accept an invitation to participate in a survey. Each survey will equal at least 1 (one) entry.
   
   
   3. Fully complete the “refer a friend” section of the registration form to invite a friend or colleague who qualifies as an Eligible Entrant to join the Live Tribe Database during the registration process (“the Referred Friend”). An email will be automatically forwarded to the Referred Friend inviting them to join and if they do so the Eligible Entrant referring them will receive an entry into the Promotion. The operation of the referring mechanic is subject to the Spam Act 2003 and in accordance with the Spam Act 2003, entrants must have the express consent of a Referred Friend before referring them. The number of entries given will be stated clearly on the LiveTribe Refer-a-Friend section of the LiveTribe.com website and members area.
   
   
   4. Complete all profile questionnaires or update profile questionnaires when requested by the Promoter. The number of entries given will be stated clearly on the profile section of the LiveTribe.com website and members area.
   
   
   5. Suggest a poll which is subsequently accepted and published on the LiveTribe website and members area. Each poll published will equal at least 1 (one) entry.

   
   

   3.2 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.



4. Number and Dates of Draws

   4.3 Entries close for the promotion on the dates and times specified in the table below. Final entries close 3PM AEDST on each draw date below. The Prize draws will take place at i-Link Research Solutions Pty Ltd, Suite 606, 267 Castlereagh Street, Sydney 2000 at 4:00pm AEST/AEDST on the dates specified in the table below. Winners will be notified by email, by mail and on the LiveTribe.com website. The winners’ names will be published in The Australian and on www.LiveTribe.com on the dates specified in the table above.

   
   

   4.4 In the event that any original Participant drawn has not come forward to claim his/her prize by 12/04/12; the Promoter may conduct a further draw on this date at 3pm AEST at the same place as the original draw, to distribute any unclaimed prizes, subject however to any regulatory authority.

   
   

   REDRAW DATE: 13/04/12 11am The Winner will be notified in writing. The results of the redraw will be published in The Australian 14/04/12.

   
   

   4.5 After the draw, the Winner will receive promotional goods, services or cash to the maximum value of AU$3,000.

5. General Terms & Conditions (all Prizes)
   
   

   5.1 Unless expressly stated within these Terms and Conditions, any expenses incurred in participating in this Promotion are the responsibility of the Registered Entrants.

   
   

   5.2 All prize values are in AUD$.

   
   

   5.3 Prize will be awarded as a AU$3,000 FlightCentre voucher valid for 12 months from the date of issue. This voucher can be used for services that Flightcentre sells, check http://www.flightcentre.com.au for available services and conditions, or the winner can elect to take the cash to the value of AU$3,000.

   
   

   A Cash prize may be awarded in the form of a cheque OR directly deposited into the winner’s bank account OR awarded through the on-line PayPal system to the winner’s personal PayPal account, with the choice of payment method at the discretion of the Promoter.

   
   

   5.4 Promoter’s decision is final and no correspondence will be entered into.

   
   

   5.5 If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.

   
   

   5.6 Any costs associated with accessing the LiveTribe website is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

   
   

   5.7 Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) a Prize.

   
   

   5.8 The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, Prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for Promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.

   
   

   5.9 Eligible Entrants consent to the Promoter using the Eligible Entrant's name, likeness, image and/or voice in the event they are a winner (incl. photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

   
   

   5.10 The Promoter reserves the right to request the Participant to provide proof of identity prior to the Game. Identification considered suitable for verification is at the discretion of the Promoter.

   
   

   5.11 The laws of Australia apply to this Promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.

   
   

   5.12 Each Eligible Entrant hereby warrants and confirms that his/her participation in this Promotion is not illegal or prohibited according to the laws of his/her country and any other applicable laws, and that he/she has obtained all necessary approvals and consents to enable him/her to participate in the Promotion. If an Eligible Entrant’s participation in the Promotion would contravene the applicable laws in his/her country of residence, he/she is not permitted to participate in the Promotion and his/her entry will be deemed invalid.
